1. Acceptance

By accessing mobycondoms.com or placing an order, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use this site.

2. Age Requirement

You must be 18 years of age or older to purchase from Moby Condoms. By placing an order, you confirm that you meet this requirement.

3. Products and Pricing

All prices are listed in US dollars. We reserve the right to change prices at any time. Prices in effect at the time of your order are the prices you will be charged. Product images are representative; actual appearance may vary slightly.

4. Subscription Orders

We offer a Subscribe & Save option on select products. By placing a subscription order, you authorize Moby Condoms to charge your payment method on a recurring basis according to the terms displayed at checkout, including:

• The recurring charge amount (shown at checkout before purchase).
• The billing frequency (every 60 days for the standard subscription).

How to cancel: You may cancel your subscription at any time before the next billing date by emailing hello@mobycondoms.com. Cancellation requests received after a billing date has processed will take effect on the following cycle.

We will notify you by email before each renewal. Subscription pricing is subject to change with at least 30 days' notice.

5. Payment

Payment is processed securely by Shopify Payments. By placing an order, you represent that you are authorized to use the payment method provided. We reserve the right to cancel orders that cannot be verified or that we believe are fraudulent.

6. Shipping

Orders ship within the continental United States. Free shipping thresholds apply as displayed at checkout. Delivery estimates are not guarantees. We are not responsible for delays caused by carriers or events outside our control.

7. Returns and Refunds

Due to the nature of our products, we do not accept returns on opened items. If your order arrives damaged or defective, contact us within 14 days of delivery at hello@mobycondoms.com with a photo of the damage and your order number. We will replace the item or issue a refund at our discretion.

8. Product Use and Disclaimer

Moby condoms are FDA 510(k)-cleared medical devices. Read the Instructions for Use included with every order before use. No contraceptive is 100% effective. Condoms help reduce (but cannot eliminate) the risk of pregnancy and sexually transmitted infections. Do not use if the packaging is damaged or the expiration date has passed.

9. Intellectual Property

All content on this site — including text, images, logos, and design — is the property of Moby Condoms or its licensors and is protected by US and international copyright law. You may not reproduce or distribute any content without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Moby Condoms shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this site or our products. Our total liability for any claim shall not exceed the amount you paid for the order giving rise to the claim.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Delaware.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the site after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated by email or prominent site notice.
